I noticed a few days ago that the little LED that lights up when the cover is closed on my 17" MBP stopped changing brightness. Now it just stays bright, with no variation.
Perhaps it changes this much for its ambient lighting sensor? I would still think it pulse on some degree no matter what the lighting conditions...

The pulsing only starts happening once in stand-by mode. When it stays bright, it merely has the display activated. It's likely busy creating an image of the RAM's contents for Safe Sleep, so you should wait a few seconds, and after that, the pulsing will probably proceed.

maybe its not going into stand-by...
i didn't plug it in overnight and today it was at 3% after closing it at around 90%...
I have checked all of the energy saver preferences and theyre all set okay...

Something is preventing your 'book from sleeping then.
There's a number of things than can cause this, I've even heard about a printer driver (HP maybe?) that can prevent laptops from sleeping.
I'd google around, as this is a fairly common complaint, as far as laptops go. I'm afraid I can't help you much, but I'm sure someone here will have some things for you to check.
