Old iPhone w/out 2 year agreement?

I was wondering if i could sign up for the iphone plan without the 2 year agreement because i just bought an old 8gb iphone from ebay.

And another question (that I don't know the answer to) is: if you have an old iPhone do you get the old data package pricing or are you stuck with the new data package pricing?
