indeed, it seemes that even Apple doesnt take it's own Human Interface Guidelines into consideration sometimes.

There's also an article from Tog at Ars Technica that discusses similar things.

Good reads which point out some very obvious flaws, and some you may not have considered. I really wish Apple would stick to its own higs.
