The difference is that the Apple version is an ascending scale where as MySpace's version is descending which ironically is somewhat emblematic of their relative popularity.

You can trademark a square of colour with the well known-and-used symbol for music in the middle ....?

Ok. Sorry but I do not see the 'design' there at all, its far too basic and generic.
