UK iPhone privacy lawsuit seeks up to $4.29B from Google

A U.K. lawsuit against Google for bypassing iPhone Web tracking safeguards now includes 4.4 million people listed as plaintiffs, and is aiming for up to 3.2 billion pounds ($4.29 billion) in damages.

The group representing the iPhone owners -- Google You Owe Us -- is suggesting that individuals could receive up to 750 pounds ($1,006) each in the event of a court victory, Google said in court documents filed during a Monday hearing, according to Bloomberg. The case has yet to achieve "representative action" status, equivalent to a U.S. class action.

At the heart of the dispute is a claim that in 2012, Google intentionally worked around Safari security settings blocking third-party tracking cookies. Advertising is the core of the company's revenue, and it may have been keen to avoid losing the portion represented by iPhone users.

When the case launched late last year, Google You Owe Us claimed that as many as 5.4 million people may have been impacted. The group is being led by Richard Lloyd, a former Executive Director of the consumer watchdog publication Which?, and previously a Special Advisor to the Prime Minister. Lloyd is also a class member of the action, and representing all potential claimants, with support from law firm Mishcon de Reya.

Precedent is likely working against Google, as the U.S. Federal Trade Commission ordered Google to pay $22.5 million for the same offense. A year later, Google reached a $17 million settlement with 37 states and the District of Columbia.

Apple has nevertheless invited Google ads deeper into its ecosystem. Earlier this month Apple gave the go-ahead for publishers wanting to use Google DoubleClick ads in Apple News articles, albeit with extra restrictions. Ads can't include HTML5 or pre-rolls, and demographic targeting is narrower than what DoubleClick would normally support.

    Excellent 60 minutes article on Google last night.  Amazing the power and monopoly this company has.  The EU is the only government with balls going after them.  They're too intrenched in US politics for anyone here even questioning their tactics better yet actually doing something about it.

    This is one of those dumb moments from Google. If they end up paying money out of their pocket for it so be it. Assuming the litigants can prove their case I won't argue with some financial penalty. FWIW the organizer seems to be promising the moon tho. If as much as $20 went to each of the class members (assuming certification) it would surprise me.

    Google always does well in court cases. They've got much better lawyers than Apple has and I'm sure they're willing to bribe whomever has control over any decisions. It's guaranteed Google will end up having to pay some minor amount and definitely not billions of dollars. Just like Facebook was easily able to get out of paying any fines or settling any lawsuits due to their data breach, I'm sure Google will also be able to avoid paying much in the way of penalties. Personal privacy isn't such a big deal to consumers. Facebook already proved that much by signing up even more users after the data breach scandal. Google is usually always able to wiggle out of court judgments, so we'll see what happens this time around.

You do realize that Android OS is the most prolific OS in the world and used by billions of consumers around the globe.     That was a good segment on 60 Minutes.
    Google may not be a monopoly, but it sure needs some regulation.
    The only thing I use Google for is a couple of trash email accounts I use to collect spam.

    How many people in this planet can AFFORD a Ferrari? About 200 million people every year??? This Ferrari comparison does not even make sense - A smartphone which is owned by every Tom, Dick and Harry (about 1 billion of them in this planet) Vs an elitist car. What do you think is the cost of an Samsung Galaxy S9/S9+ or Note 8 or Pixel 2/2 XL or Huawei P20 Pro/Mate RS? The people who buy those phones cannot afford an iPhone??? Seriously???

    Obviously not since Apple themselves recognize a truck is sometimes the better choice even if you don't. If price was the only deciding factor there would be no Galaxy S8/S9 sales, LG V30's sold, Google Pixels being purchased...

    People buy Android devices because they’re cheap, good enough, and because everybody else uses them too. It was and is the same with Windows PCs. Android and Windows users are the true lemmings and sheep of the tech world, not Apple users as trolls like to claim. And that’s perfectly okay. An Android device will get you where you’re going just like a $13K Chevy Spark will. People buy iPhones because they want something better... better design, better functionality, better security, better hardware, better software. And that’s okay too. Android OEMs tend to “borrow” from Apple’s designs to make their products appear to be of the same caliber, but they are not. While the Chevy Spark will get you to the grocery store just as well as a BMW X5 I don’t think many would claim they are therefore equivalent.

    Most consumers have no idea how much they give to Google and will never read the 40 page terms of service agee. Google also does a lot of sneaky things that unless you frequent non Google loving sites you will never hear about since they control search and I turn the internet. Any articles critical of them will be way down the search pages unless you are very specific In your search and sometimes even then you get nothing on the top page. 

    They also hold power over companies because search rankings especially for new agencies and blogs etc determines their visibility and income. Some companies have experienced down grades in ranking for no reason when they are not in Googles favor 

    Just because Android has billions of users doesn’t mean they aren’t thieves. They steal products then give it away for their benefit. They can give it away because they didn’t have the 5-6 year investment in resources to create it. They pretend it’s their idea and because they can control what 99% of their customers see, no one will be the wiser.

    The British Legal System is pretty well independant from political pressure. Judges do not like being told what verdict to bring in. If you have proof that Judges are being cough, cough, pressured to side with Google then a lot of people including the UK Police would like to know and pronto.

    This was back in 2012. The U.S. got a bunch of money a year later? So 2013. I know I didn't get a penny from that lawsuit!!!! It's now 2018. This happened 6 years ago and NOW they're going to sue Google? What the hell took so long? Do people really think they're going to get over a grand each? HAHAHAHAHAHA, never going to happen. What Google did was wrong, but come on, this is just flat out crazy at this point in time. What new Privacy laws there are now, doesn't effect what happened in the past.
