Mine is, anyway.
When it turns on I hear the HD spin up, the Apple logo appear, then a folder with an !.
Reseting it and holding down << and >> just makes the Apple logo stay there (frozen in other words).
Does anyone have any bits of advice?

You should press and release << and >> and select at the same time (select being the button inside the scroll wheel).

Happy ending. I got a new one, the old one was declared DOA.
BTW, my original 15GB also had a faulty battery meter. I wondered if it was normal, but my new one has a fine battery meter.
