Hearsay isn't the right way



While there are contentions that this may make domestic violence, abuse and rape claims harder to prosecute, I would rather have the rights within the bill of rights protected.



The Supreme Court, in a 9-0 ruling basically tossed out the admissibility of hearsay evidence during trials. This is increasingly important as prosecuters have found ways to get statements in to prove the guilt of people during cases without the defense having the ability to cross-examine them. In otherwords, one of the most basic constitutional rights, the right to confront your accuser, has been reaffirmed in the strongest way possible. I would rather have a few guilty be free than a few innoncent be convicted off recordings or officers testifying on their behalf without cross-examination.

    I thought this was about an AppleInsider member named Hearsay "My God what did he do that was so bad??"



    Anyway yes that's great news.



    If you can't prosecute without using hearsay, too bad. Yes even if it was mom or wife or daughter that was raped, so let's not go there.
