Scanning in books and copyright question

I'm pushing for the idea of my department scanning in our existing textbooks and giving our students CDs with the books in PDF instead of the actual textbook to avoid deteriotation costs. Surprisingly it can cost us more than $1000 a year to get books rebound.

I would think this would fall under fair use, because we will still have one physical copy of the book for each student, but my colleagues are nervous.

Can anyone here say for sure if this is legal?

I once got an F in class because I decided to be a wise ass and asked the teacher in front of the class when she asked "are there any questions?" if she had had permission from the publisher to photocopy the pages of text we had to read and analyze for a test.

    Bitch.

Uuh. To answer your question. Just do it. I wont tell. and just hope you dont have any wiseass students like I was (am?)
