iPod Shuffle warranty questions (IMPORTANT!)

I bought an iPod Shuffle 2nd-gen a month ago.

It didn't work with my system at all and after a month the dock quit working. Yesterday I requested a replacement unit.

There's only one problem.

I just did a fresh Windows install, my old iPod works and the replacement doesn't. I'm using the new dock.

They say I have to send back the defective iPod.

The one I've had is no longer defective.

I'm trying to avoid getting charged a $95 non-return fee.

I don't want to go through indefinite repeat replacement orders and send back a now perfectly good iPod.

The old dock doesn't work at all. The new one does.

The old iPod works on the new dock and the new iPod doesn't work at all.

What should I do?
