Can you believe this?

So...I got a new ipod (10 gig) in mid Jan, and it was dead on arrival. I sent the unit back, and waited...and waited...and waited for a new one. While waiting, I called to inquire why it was taking longer than predicted, and the operator said an order was not created. So fine, they created another order. Several days later I received my ipod. It's great. Well, this afternoon I received another package from Apple. And it is ANOTHER brand new ipod. How can they do this to me? It arrived on Valentine's Day, and my girlfriend opened it and thought it was my gift for her!!! Can you believe it??? I was going to go with the flow and take full credit for the best Valentine's gift ever, but then realized I need to return this, and proceeded to give her a crummy box of chocolates...what a disaster! Through gritted teeth, she said the chocolates were great, all the while eyeing the cute little unopened ipod lying on the table. I need to hide this thing before it disappears. So, thanks Apple...I couldn't think of a better way to be upstaged on V-Day. Thanks a ton...

PS - Who do I call to return this puppy (it came from the online store). Any chance they'll give me a gift certificate for my upstanding character?

Just be sure to get all the shirts and stuff she took from you back to your place or you'll never see them again.

You're a better man than I am. Call me dishonest but I would have kept both unless Apple raised a stink.

I'm sure Apple wouldn't miss one iPod.

I'm with you satchmo. I wouldn't be saying a word until apple said something, or billed me.

justmyluck, did apple bill you for this?

My next-door neighbor (dorm) actually had a similar thing happen with a 17? monitor from Apple. When the second one came, he called Apple and the person he spoke to said that it was a mistake on their part, but that since the computer didn?t really report any problem with it (the second monitor was marked as a sort of ?Paid for by: Apple? because his first one got lost (actually delayed) in shipping) the guy he spoke to said he could keep it. Disgruntled employee maybe. Anyway, he just sold it on eBay and bought an iBook. I was totally blown away.

No, I was not billed for the second ipod. I got the standard...'Applecare repair service photocopied letter'... that is sent with all repaired products.

By the way, my girlfriend, who is now more than a bit intoxicated (I had to compensate and take her out to dinner), is cheering in response to all of these replies...

Well, the way I see it, that's their mistake. If they can't keep track of what's going where, then it's their loss.

I'm afraid that that's the way the big ball bounces...

Go on... spoil your girlfriend right up...

Keep it if you want, but just because they screwed up doesn't mean you deserve it.

and btw, I sure hope I never drop my wallet around any of you guys...

Now I'm about the most honest person in my whole school, I don't have a single piece of cracked software on my computer.

But look at it this way, Apple Have $4,000,000,000 in the bank and through lack of administration have sent you a £250 piece of hardware - it's THEIR fault - and they're really not going to miss it as they produce a new one every few seconds and it's only going to cost them extra to take it back from you.

If you gave a tourist 1p to much change would you want them to bother mailing you a 1p check from their home country when they realise the profit they've made? (okay, stupid example but my point still remains valid)

Keep the iPod - everyone's a winner (sort of )

Anyway, it's not illegal, if someone doesn't invoice you you don't have to pay (as far as i can tell)

What I'd like to know is where I can get the free iPod. Just keep it, if you can live with it.

Years ago, I was receiving cookware in the mail from a company I had never heard of. I tried calling them, but they had no record of the items being sent. I asked a lawyer if I was being scammed, and might eventually be presented with a large bill. He told me that a person can legally keep any unsolicited package that came to them in the mail.

You might ask a lawyer in your state if this still applies.

Oh come on, I don't think you can compare the two. Losing the contents of a wallet such as credit cards and personal info will affect an individual greatly.

However, an iPod will not even register a blip on Apple's bottom line.

Plus I'd venture to guess that most here would return a wallet...perhaps less the cash of course

Keep it. Or you can send it to me and I'll "send it back".

    flick.

why dont you return it and get a refund?
  • Reply 18 of 49
In American consumer law, if you're given something you didn't ask for and didn't pay for, then you are under no obligation to give it back or pay for it. Did you sign anything when you returned the iPod that may have had small print saying that if Apple makes an error, you have to pay for it (semi-likely). But anywho, if you didn't sign anything, then the second iPod is yours if you want it.

What Apple did in simple terms was give you a gift!

well, sorry to be the wet blanket, but personally i'd just call them up and see what they wanted me to do. you shouldn't have to pay to ship it back if they want it, but you should at least ask what to do with it.

there's a decent chance they'll tell you to keep it, in which case you won't be bothered by a guilty conciense.

Stick it in a drawer just in case they call you up and raise a stink over it.

If you don't get a call in a couple weeks, fire that puppy up.
