Deleting files which 'are in use'

I've had a read me file sitting in my trash for the best part of a month now, and everytime I go to empty the trash I get a warning that this particular file is in use.
How can I force the trash to empty this file?

Usually secure empty trash works for me.
You can also open the terminal and type sudo rm and then drag the file from trash into the window and hit return.
