For a long time, Apple didn't pre-announce anything, it was announce & release to stores within days or a couple weeks. Maybe preannouncing in advance of release was started with the Tiger demo.
Actually, it seemed more like they wouldn't pre-announce in the classic sense, but their announcements would always come with anything from a couple weeks to couple months prior to actually shipping the product, and even then there were delays.
For example, forgetting the pre-announcement for a moment, the AppleTV is a perfect example. Shown off at macworld, but then listed as a "month" away, then pushed a couple of times after that.
Illegal advertising has become a problem for the city over the past couple of years. I think the huge multi-story billboard for the Da Vinci Code was the last straw. The city has begun to crack down on it. But I'm not sure of rules of someone advertising their own product on their own property.
Update: As of Tuesday, Apple has removed the billboard from the south side of the cube. It's unclear when and if it will return.
My guess is that Apple made the poster for a different location/event, knew that they would be forced to take it down almost immediately, but knew that a huge, in-your-face ad wouldn't hurt to pump further iPhone chatter... especially with camera phones and mobile internet being so dang ubiquitous.

What I dont see is that how that was any differnt from the rest of the ads around New York City. Arnt they all "huge and in your face"?
No. Most of the huge ads are in or around Times Square. There are some other public areas around the city where large advertising is allowed but you have to get permission. For most of NYC large advertising is not allowed.
5th Avenue is a wealthy neighborhood that generally does not have large gawdy advertising. But I have seen stores on 5th Avenue wrap its own advertising around the building to cover construction activity. A giant sign that says "coming soon Louis Vuitton", stuff like that.
I don't see what the point of putting this up now it. Most people I know eventually get sick of ads after they're up/around too long. Put it up in may that way most people won't be pissed by the time it really drops saying "i'm so sick of that picture, just release the damn thing already!" Like most mac users already feel for the appletv.
Recently spoke to a friend who knows about these things. He said the advertisement does not violate city codes. He speculates its stealth advertising by Apple to have people talking about it just the way we are now.

i don't know dude. i remember walking down 5th ave with my mom and seeing a giant jeniffer lopez holding a loui vitton bag and starin at me on the street
I just hope the size of this ad isn't as big as the flop the iPhone could be. I know you have to be confident about your products, but the high expectations set scare the crap out of me.

5th Avenue travels from the Village to Harlem, from 8th street to 145th street. So yes at some point somewhere along that 7 mile stretch I'm sure you can find a large advertisement.
I'm specifically speaking of the the premiere shopping area between 48th and 59th street where the Apple store is located. There are strict rules on advertising in this area.

If it matters to anyone, the sign was up and down in the same day. By 9pm EDT on Monday they had taken almost the entire sign down, with scaffolding still up.
