The technology is Novell's if it isn't under GPL. Contrary to what the FSF wants you to think not EVERYTHING is GPL in open source. And Novell doesn't owe the community anything except complicance with the license terms.

Oh really what? Novell doesn't owe anything more than compliance with the license, including any new patent provisions, should it choose to distribute under GPL v3.
Whether MS is distributing is debatable. Certainly if they cease any potential form of distribution prior to GPL v3 then MS is not held to the terms because they never distributed under GPL v3.
Frankly its a stupid move on the part of FSF but hey...I'm an open source proponent...not a "free" software proponent. I'm insulated to a great degree what the FSF does. The MS-Novell deal seemed neutered already. By pushing to the next step they might beat Novell into submission or they might force Novell to more closely align with MS.
Corporations are still run by people. Jab folks with a stick and you might get submission or you might get a jab right back even if it is self destructive.
