Help, pesky .Sit file that I can not trash

I downloaded a patch for my Diablo game, but for whatever reason, it never fully downloaded. Now it is sitting on my desktop and I can not trash it. It wont fully unstuff, and it definitly will not leave the desktop. It says this when I try to move it to a folder or trash it

"The Item "Diablo II OSX patch.sit: is being used by another task right now. (other tasks include moving, copying, or emptying trash)"

Now trust me when I say that I have tried everything imaginable to me (yes restarting computer

) If anyone can toss me a bone, that would be greatly appreciated.
