[quote] Be Inc. , the failed maker of a computer operating system hailed by some as a high-powered rival to Microsoft Corp.'s dominant Windows platform, said on Tuesday it is suing the software giant for allegedly destroying its business through anti-competitive practices.

Menlo Park, California-based Be, most of which was acquired last year by handheld computer maker Palm Inc. , said in a filing with federal court in San Francisco that Microsoft struck deals with PC makers barring them from installing more than one operating system on computers they sold.

"Microsoft harmed Be through a series of illegal exclusionary and anticompetitive acts designed to maintain its monopoly in the Intel-compatible PC operating system market," Be said in the statement.

    Same old stuff.

Of course we all hope Be will win something, but nobody ever beats Microsoft.

    Why can't Be just die?

Wow. In this case I'd say Be has a decent case, but then so did Nicole Brown Simpson's family and look where it got them.

perhaps because they had a quality product that many loved and maybe because they actually have a case here. this was no secret.

    Be may win this.

I'm interested in seeing what they want in return

Funny, I didn't think that Be Inc was still around. I wonder who is behind the lawsuit? The wall street journal had a short blurb last week stating that Gassae went to another company.. <img src="confused.gif" border="0">

Yes I know that Be was bought by Palm. Read the original quote. It says that Be Inc is suing, not Palm.

dude, sometimes you can be very thickheaded...you need to develop some people skills esp if you want to work @ an apple store....

if you read the quote it says that "most of which {be} was bought by palm" implying that some parts of Be Inc. are independant and they are the ones sueing... and TD was wondering who @ Be Inc was behind the law suit...

Now, if the original quote is wrong and all of Be was aquired by palm, then this is a different story... but based on what was said this is what TD means... (i think)

However, Palm is not a friend of Microsoft and more precisely a friend of windows CE.

I think Be has a strong case. There is a great article on the register <a href="http://www.theregister.co.uk/content/7/24134.html"; target="_blank">here.</a> The most interesting part to me was this

[quote] Hitachi had agreed to license BeOS, and ship a dual-boot system using Be's boot loader and an icon on the desktop that enabled a Windows user to reboot into BeOS with one click.

"Microsoft sent two U.S. managers to Japan who expressed their 'anger' with Hitachi over its arrangement with Be, and 'reminded' Hitachi of the terms of its Windows license," according to the claim. " <hr></blockquote>

If that is not obvious anti-competitive behavior, I don't know what is.

yea, that's great. it has nothing to do with what TD said

TD said he thought Be was not around anymore and made it seem as if he did not know which one. I said palm. And then he made some rude ass comment how he knew it and then tried to point out as if I had not already read it that Be itself was making the lawsuit.

    [quote]

On November 12, 2001, Be stockholders approved the sale of substantially all of Be's intellectual property and other technology assets to a subsidiary of Palm, Inc., and the subsequent dissolution of the company in accordance with the plan of dissolution. Pursuant to the terms of the asset purchase agreement with Palm, Be retained certain rights, assets and liabilities in connection with the transaction, including its cash and cash equivalents, receivables, certain contractual liabilities under in-licensing agreements, and rights to assert and bring certain claims and causes of action, including under the antitrust laws. On November 13, 2001, Be completed the sale of its assets to the Palm subsidiary. Be's headquarters have moved to Mountain View, California and can be reached at P.O. Box 391420, Mountain View, CA 94041. It is currently publicly traded on the Nasdaq National Market under the symbol BEOS. may be true, but it costs nothing to be nice... condesending remarks help noone...

OK, I missed the little jab that TD made at you... but the point is, you didnt have to jab back...

Im just trying to point out that you seem to jump at people a lot here and it really isnt nesscesary... maybe the thickheaded comment was out of line, but i just wanted to get your attention...

If Microsoft didn't own and run america (as opposed to the so called elected government) Be might have a chance.

Doesn't it sicken you guys that Microsoft happens to own your government and national institutions?

HAHAHAHAHA. Money may get a lot of Republicans to look the other way and pull some strings, but IN NO WAY does M$ even jokingly have anything resembling authority and power with our government. Republicans are too much into their own agenda and Democrats hate M$.

If that's the case then how come Microsoft continually blatantly pursue its tactics yet get away with it? Even IBM got pasted
