I've recently rediscovered it, but my first foray into battlenet was pretty damned awful. Some level 79 barbarian kept killing my poor little level 7 character.
anyway the reason im asking ( now dont freak out, im a good person) is that i quit about a year ago, and now i want to restart, but my cds are not in good enough condition to reinstall with, is there somewhere i could download it that any of you know of? keep in mind i have bought the game and still have my cd key

no, I don't know where you can download the game. Perhaps you could contact Blizzard directly? They'll be able to confirm your identity and send you a new CD, I imagine. In case you haven't checked recently, you can pick up D2 for about $20 from most places. If not cheaper.

Because while we've been doing this, I've boxed up 12 boxes of books (12x10x8) from my *small* bookcase in preparation for a move across the country at the end of the month.
I got the game as soon as it came out, and the expansion too, but haven't played with them in a year or so. Perhaps I'll load Diablo II up to kill some summer free time.
The upcoming 1.10 patch should be very interesting, since it rebalances a lot of play issues... it's practically a new expansion by itself.

Blizzard WILL replace your damaged CDs. From the Blizzard web site:
Damaged or broken CD:

Well, as I said, the upshot is that new CDs are very cheap. I routinely see them for around $20.
