This is the one with legs.  Though the iPhone 6/6+ aren’t new, some recently purchased phones saw the slowdowns while the battery still tested “good” at the Apple store (based on comments on the subject here over the last couple of days).   A judge will decide based on the preponderance of evidence, which is:

- a previously admitted battery flaw and replacement program
- a previous admission that the shutdown problem grew to affect other models
- a newly admitted slowdown algorithm that kicks in before the Genius Bar says the battery is eligible for replacement 
- performance results that are half of the phone’s performance when new

In this context it will be very difficult for Apple to claim their motivation was user experience, since it sucks anyway at half-speed. 

I object to the phrase, “it has been conclusively proven that Apple isn’t slowing older devices” when the linked article shows this

Senator Rubio has a point here. Apple has a double standard. What is your problem with that?

Or is it Rubio who has the double standard?  He is in a position to actually affect policy. He could start an effort to remove most favored nation status from China if he feels they are repressing free expression.  He could advocate for human rights throughout the world.  His party controls the entire government and could pass legislation tomorrow.  But no, he will abdicate his responsibility and criticize a computer manufacturer for not managing US foreign policy. 

Good for them. Taxes not paid by corporations are taxes paid by the rest of us, yet they benefit disproportionately from roads, airports, labor force, government research, and the rest of the national infrastructure.
