    You can setup an Apple Watch to be independent of an iPhone using Family Sharing but it is not fully functional. Calls do work on a cellular Watch but not every feature is available.

    Market share is not the whole story; to show an illegal monopoly, the DOJ will have to prove that Apple maintains that market share by coercion, market manipulation or price manipulation. If US consumers simply prefer iPhones by a 2 to 1 margin, that’s not illegal. The case, as filed, faces some real challenges.

  • Apple won't license Masimo's patents despite Apple Watch import ban

    Apple has several options, all of which they are likely pursuing except settling with Masimo.

    First, Apple is trying to get Masimo’s patents invalidated, likely for obviousness or prior art. If they succeed, no patent equals no infringement and Apple will be free to reintroduce oximeters on their watches.

    Second, Apple is very likely redesigning their pulse oximeter for the Watch Series 10 so as to not infringe the claims in Masimo’s patents. This would solve the problem going forward but would not allow return of the feature to impacted Series 9, Ultra 2 watches.

    Third, Apple is obviously appealing the ITC decision. The initial ruling that the ban wouldn’t be stayed during the appeal doesn’t mean the appeal won’t ultimately be successful. If Apple succeeds, Apple would again be free to reintroduce pulse oximetry to all Apple Watches.

    For people saying Apple stole Masimo’s technology, that’s almost certainly not literally true. Patents are deliberately written as broadly as possible to maximize their impact and to make them hard to design around. The appeals process will sort this question out unless the patents get overturned.

  • Masimo has spent $100M in Apple Watch patent infringement fight

    Currently, it is unclear that Masimo will prevail in the long run. Apple will completely end this if: 

    1. They succeed in having the last two Masimo patents invalidated for obviousness.
    2. They can engineer around the patents through software or hardware. Apple obviously prefers the former as hardware changes leaves Apple unable to sell older watches. Apple would have to pay damages in this case but in no way will they pay the $3B dollars that Masimo wants.
    3. The ITC import ban will also likely go away as Masimo does not have a significant domestic industry to be protected. That is part of Apple’s appeal there.

    Overall, Masimo may get money for past infringement but they also may get nothing. A complete victory seems very unlikely.

  • Apple files legal challenge over Europe's demand for third-party app stores

    Forcing third party app stores isn’t the same as forcing Apple to allow third party in-app purchases on the Apple App Store like Epic is demanding. Apple won’t be hosting or advertising the content. But it still would allow developers to circumvent paying Apple as long as they could live with the inconvenience of getting users to use the alternative store.

    A bigger question is how does this impact the Apple eco system. Some say that developers will charge less is they don’t have to pay Apple’s commission. I suspect that most developers will pocket the bulk of the savings.

    Large content publishers and distributors like Epic and Spotify will come out ahead while consumers will get a little more freedom and savings. Not sure who else wins. Apple might start charging for major iOS updates or increase developer fees as a way to recoup some of the lost revenue.
