Microsoft/Nokia sue Apple for infringement

Microsoft and Nokia, thru their holding company proxy Mosaid, have sued Apple for patent infringement. Again using standards-pledged (FRAND) patents not licensed by Apple in the last go-round with Nokia, this group of patents were assigned to Mosaid back in September from Nokia. Does this mean MS is feeling their oats from the successes they've had with Android vendors, with the gloves coming off against Apple now?

    I finally noted the Apple devices that Nokia/MS, under the auspices of MOSAID, claim to be infringing on their IP.



    It's a pretty broad list and includes:

    -iPad

    -iPad 2

    -iPhone 3G

    -iPhone 3GS

    -iPhone 4

    -iPhone 4S

    The patent system is complete garbage, but Apple uses it to their advantage as much as people try to use it against them.



    IMO, eliminate all patents, let everyone fight it out in a free-for-all, and may the best product win.

    So remove all incentive to actually create stuff. Remove all protection of your intellectual property. That's not gonna work. You'll see prices skyrocket and copyright and trademark lawsuits replace the patent ones.

    Tho it's been out of the news MOSAID (CORE Wireless) is still proceeding with it's patent infringement lawsuit targeting Apple. In case anyone overlooked it [I][B]and despite Apple's cross-license agreement with Nokia[/B][/I], MOSAID is using Nokia IP against Apple yet again. MOSAID is of course a Nokia/Microsoft Patent Assertion Entity, another one of those immune-to-IP-counterclaim, non-product producing "patent trolls" as they're commonly called.

    Apple's request to transfer the case out of patent-holder friendly Texas was denied initially so Apple appealed it to the Federal Circuit. Yesterday that court also denied Apple's motion. So a Texas court it is.

    For anyone wanting to know where the royalty goes if MOSAID is successful , it will reportedly be a three way split of Apple's money with a third going to MOSAID, and Nokia/Microsoft sharing the other two-thirds tho the percentage split between the two wasn't specified.
