    You should read the whole thing...
    Offering the same service would not be an offense whatsoever. Misguiding customers by pretending you belong to, say, a chain of reputable repair shops by mimicking their shop design, uniforms etc. would be a violation. This is neither broad, nor hard to understand.

    And actually it is pretty common business ethics, valid even in most countries without such a law or regulation. Why was this law created in Germany? Because Germany creates most of its GDP from small and medium sized businesses, which simply can't afford to file patents, trademarks etc. for each and everything they do. This regulation guarantees them some kind of protection at no cost. We can argue the actual contents and wording, but I think the idea has some merit.

    Thanks for clarifying that. God forbid Trollest Shill would write something positive and productive instead of attacking someone.

    I'm guessing if you advertised your car service as being identical as mine, which similar signage, storefronts, slogans, etc. which could confuse someone. Remember it has to meet the criteria listed and give an "overall impression".

    That said, yes it's broad. That's why I like it. Broad laws, in the hands of competent judges, allow common sense to win out. But yes it can be abused. So can narrow laws, which suffer from loopholes and technicalities.

    Thanks as well, I can always count on you for a straight answer. Though I agree the courts could also see a slew of lawsuits with such broad language.

    Samesong has copied Apple's brilliant 'Apple- Intention' video, too. As with previous copyright claims against them, they made slight changes and reposted. See if you can spot the difference(s).

    Samsung - Imitation

    if Apple
    is busy making perfection
    we don't need to innovate anything.
    we can confuse convenience

    designing only requires
    cloning%u2028
    the first thing we ask is%u2028 what is Apple creating?
    we deconstruct
    imitate
    replicate
    flood the market
    then we slowly litigate in the courts.
    it takes time%u2026
    there are a thousand appeals
    to every defeat.
    we countersue
    we slander
    we ship

    Let's hope there are many more strikes against Samsung in the near future. Could make a company second guess their decision to be in the ripoff phone and tablet market altogether.

    We agree with your first sentence.
    It is a given that Crapple wins lawsuits in these three countries (interestingly, all of these countries have a dubious history when it comes to imperialism, racism, and xenophobia):
    <ul id="user_yui_3_10_0_1_1372206812558_823" style="margin-left:38px;color:rgb(24,24,24);font-family:arial, helvetica, sans-serif;line-height:18.1875px;"> [*] USA (protectionism)
    [*] Japan (Korea hate)
    [*] Germany (Korea hate, see the 2012 BBC poll at <a href="http://en.wikipedia.org/wiki/Anti-Korean_sentiment" id="user_yui_3_10_0_1_1372206812558_830" style="border:0px;line-height:1.231;" target="_blank" name="user_yui_3_10_0_1_1372206812558_830">http://en.wikipedia.org/wiki/Anti-Korean_sentiment</a>;
    , the Jew murderers have the highest hatred for Koreans of all countries analyzed)

    </ul>

    Godwin's law is alive and well I see. Of course that makes you lose immediatly.
    All those Germans are racists. All the Japanese are racist. All the Koreans. And you're calling others xenophobic. You're a real piece of work.

    We said it before, and we say it again:
    Only three countries in the world where Apple can win these silly lawsuits:

    <img alt="" class="lightbox-enabled" data-id="27501" data-type="61" src="http://forums.appleinsider.com/content/type/61/id/27501/width/500/height/1000/flags/LL" style="; width: 500px; height: 281px">

    Who is "we", you and your Samsung paymasters? You just named the top three economies in the world, except for China, which has no respect for IP, so Samsung better find a legal way to compete in them. Funny how Kia and Hyundai face no issues in the US. The US is a net importer - by a lot, so I guess it's just poor Samsung getting picked on, huh?

    Very slowly, but surely, Samsung will be exposed for what it is. The list of infringed patents is long - there will be many trials and many awkward workarounds. Enjoy your blue glow for list scrolling. Stay tuned for more!

    That is absolutely true. Before you could always pick out an Apple product owing to the iconic white packaging. While white was used by other manufacturers as well, it was never as dominant as it was on Apple packaging.

    Now with the Samsung phones and tablets, there are rows and rows of white boxes and everybody seems to be using it.

    Is the term 'fatalistic troll' taken? There seems to be a breed of troll that knows it will be banned, does not care since it can always come back with a different ID and post crap again.

    Who is this `we' you cite in your first statement. You want to rant about how Germany can't stomach South Korean business practices you won't get any sympathy from Apple fans. You won't get any sympathy from Japanese electronics manufacturers, or any other region of the globe where Samsung does a clone, pump and dump approach to business, while being a national conglomeration.

    I sure as hell won't condemn Germany for the poor business and political relations South Korea has with them. That's between their countries and outside the scope of this board.

    Grow up and differentiate your topic baiting on a board people might give a rats ass about. This board aint buyin' it.

    @belowfreefifty Is that so? It would seem that your racist logic needs some thinking about.

    Don't feel any need to react to your other nonsense, as it disqualifies itself... But the BBC and the people polled there deserve some correction.

    The poll quoted was not asking about hate, disrespect or even just biases. It was clearly about the opinion on the global influence of each country. Now, people in Germany have very little, if any, reason to consider Korea's influence to be positive. A lot of our (and other's) goods get copied there, Korea floods our markets with unprecedented junk, and it does not even make for a good holiday destination (food even worse than ours - an achievement, I am delighted to confess - and bad weather; yes, I know for sure because I have spent almost 3 years in Incheon). Face it: torturing Pierce Brosnan is about the only positive on your list :devil:

    Oops.. I gave you a thumbs up... but you are dead wrong on the food sentence! As a German, how can you possibly even say that? I decided to stay here for just that reason, great food... but more importantly, the best bread and the best beer in the world. Period.

    Heil Hitler!

    WWII was a long time ago. While it should never be forgotten, do not compare a court decision about cell phone copier to the atrocities committed.

    <span style="line-height:1.231;">There's no doubt that Samsung intended to use the same basic style as an attraction.  Where that's against the law, they should get nailed for it.</span>

    As to confusing customers, it's not believable for someone to walk into a store to buy an iPhone and "accidentally" buy a Samsung instead.

    It's not like they're buying a box of cereal.  <span style="line-height:1.231;">For one thing, stores don't leave boxes of expensive phones laying around.  You have to ASK a salesperson for the phone model you want, so they can bring it out of locked storage.</span>

    So if someone comes in wanting an iPhone and leaves with a different phone, that's an outcome caused by salespeople getting involved and talking the customer into something else.   Everyone knows this happens.

    As for being called ridiculous, that makes two of us. I totally agree with this. How the hell can you not buy an iPhone if that's what you went to buy??? It's not like they sold you a fake iPhone but a phone of a total different brand!! Do you see the word iPhone on the box when you buy it?? Do you see the Apple logo?? Don't you see Samsung, galaxy or whatever on the box of the phone you just bought??? How stupid are they??
