I'm late to the comment party (again) but FWIW, tort like liquidated damages in a contract are generally unenforceable. This doesn't mean they aren't effective in making a party nervous about them.

It's not different then you order a item from Amazon, the item never came, you ask for a refund but next thing you know is the merchant is keeping your money and you never got the item. And further, ther merchant is blaming you for u being burdensome for asking for overnight shipping instead ground...
