They could cap the processing power or the Watch could warn the user how much it's draining and the developer would know to make it more efficient.
The ?Watch already does a number of things that are a massive battery drain. If Apple were restricting watch faces because some would be a greater power drain, all they would need to do is display a disclaimer before a user was allowed to select that particular face.
As for copyright designs ... My whole point. Why doesn't Apple let me create my own ringtones out of music I own in my iTunes? Because Apple takes 50% off the top for the ringtones, music and apps it sells? Where is the harm in letting me create my own ringtones, or watch faces out of something I own for my own personal use?
Custom watch faces are a no-brainier, it's the one major design thing an ? Watch can do that traditional watches can't. How hard would it have been to dedicate a single employee to develop a watch face app for user customization? That would be far more meaningful to me than digital touch and sending your heartbeat to somebody, something I will likely never use.
If money is not the motivation, copyright infringement doesn't really hold up as an excuse. Perhaps third party selling of watch faces, but certainly not building my own for my own personal use. Considering this is primarily a watch, again dedicating someone to vetting submitted watch face designs for copyright infringement is a no brainer. And power usage is not an issue either considering there are so many power sucking activities on the watch already requiring user discretion.
Again, I'd like to know why given the major fashion push by Apple, why we've heard nothing of third party band licenses to major fashion houses and watch faces to go along with them. This isn't a simple matter of, 'hey, we're just concerned for the end users power usage, and don't have the resources to vet the deluge of watch faces developers are sending us'.
Hopefully they allow third party faces soon. I want to simulate the movement of a watch I have that had three faces that rotate around one hand (instead of three hands that rotate around one face)

You could do this this on your own programmatically without waiting for WatchKit.

Nope. That may be a concern, but it's a concern with any third party app. Apple would not be responsible for content in a third party app they merely sell in their store, anymore than Amazon would be responsible for selling a book that contained unlicensed copyrighted works. But that wouldn't stop them from getting sued too, doesn't mean Apple would lose. So if it applies to watch apps, it applies to all apps.

It works better with the seconds on the outside so you don't have to read right to left. Having different faces is a huge advantage over traditional watches because you don't have to buy a whole new watch just to get a new watch layout. That style wouldn't work on the ?Watch unless it was shrunk down but it can be done in columns instead.
