Swatch looks to trademark 'one more thing' phrase made famous by Steve Jobs

    Look...it's just a common phrase right?

    As far as is common knowledge it was made famous by Peter Falk playing the part of a Detective called Colombo in the TV Series of the same name.
    Did he trademark the phrase? No. Common sense prevailed. It's just a common phrase FFS!

    The same phrase was then used by Steve Jobs many times and became associated with him.
    Did he trademark the phrase? No. Common sense prevailed. It's just a common phrase FFS!

    Now Swatch want to trademark that very same phrase. I mean what are they smoking? It's just a common phrase FFS!

    There is no way this should even be allowed IMHO.

    I mean other people I am sure have used that same phrase including myself many times.

    So if anyone uses that phrase in public will they be sued by Swatch going forward?

    How would you enforce the patent in any case?

    How ridiculous that Swatch is even thinking about trademarking a common phrase used by many people over many years.

    Says more about Swatch as a Company and USPTO as an organisation to even consider it let alone action it.

    A quick Google search for 'One more thing + Colombo' returns 286,000 hits

    The same search for 'One more thing + Steve Jobs' returns 90,800,000

    Try that by substituting Colombo or Steve Jobs with Swatch and that returns 5,930,000 hits (subsequent search now shows 7,800,000 hits?) most of which also mention Steve Jobs as far as I can see.

    It's a common phrase FFS!

    Are we sure this is not a joke?

    What next...apply for a patent on other common phrases in our vocabulary?

    I could think of more suitable phrases for Swatch I'm sure. How about;

    One foot in the grave?
    Cry all the way to the Bank?

    Both of these as trademarks are a fools game. "Tick different" is already too close to "Think different", the "one more thing" would be a weak trademark with due to plenty of use by their competition (Apple) and also existing as a cliche.

     

    If Swatch were silly enough to use "tick different" in a campaign it would be a trivial infringement of "think different." Since it's straight forward to argue that it's aims to imply an association with Apple.

     

    Using the "one more thing" phrase would be trickier to prove as infringement as it would depend how they intend to use it, but ultimately the phrase has been associated with apple launches for long enough to argue that it again implies an apple partnership.

     

    Misleading consumers = bad, no matter how "controversial" they want their product to be. The fact of the matter is that there is no watch maker who has the technical ability in software and hardware to produce a product that exceeds the apple watch's functionality. You can fart out an S1 chip and battery sipping software combination in the size of the apple watch. The watch is the result of years of honing iOS and hardware manufacturing capability.

    It's much more specific than that as it was actually used. I looked it up (note there's a link to the application itself).

    The silly tech journalists assumed that SWATCH was just a heading indicating who took applied for the trademark. I suspect they've actually used this term before, but with the extra word it doesn't really sound like the Jobs quote. They're using the name SWATCH, which I'm pretty sure is an acronym, as an active verb to complete the sentence.

    Meh, seems like worrying about a company that is skating to where the puck was a decade ago when the phrase elicited excitement.

    Today, Apple's presentation and announcement style is different. We're not on the edge of our seats salivating for that phrase from Steve anymore.

    You are right about that, but it was refreshing when Tim used it to introduce the ?Watch.

    To me, it wasn't. When Steve used it most of the times you had no clue what to expect. When Tom used it it was clear it was for the watch.

    Are you sure about that? I can't imaging any major release that didn't have rumours swirling months before. Remember the iPad? That year at CES there were dozens of tablets saying "me first" before Apple had announced a thing.

    When Jimmy Iovine last took the stage, I was on the edge of my seat...mainly because I fell down backward in horror.

    While watching the 2004 Season 10 Friends Episode 11, "The One Where the Stripper Cries", the Chandler character says, "Just one more thing." Upon hearing that I a great laugh. It amazes me how many companies speak negatively about Apple, but stop at nothing to imitate Apple.

    Thanks! I actually have all of the available Apple conference videos on my computer. Seeing the Friends episode just made me laugh that Swstch thought it would be INNOVATIVE to trademark a slogan so synonymously linked to Apple.

    On a similar path, a short while ago I wrote a letter to the Department of Justice that referenced Steve Jobs explaining to the application developers in the world how they could make apps available to Apple's iPhone customers. There was the FREE Web which Apple supported 100% and the 30% fee App Store. Developers had a choice. Developers still have a choice. With nothing but love for Spotify. DOJ, FTC and EU Commission, Spotify has always had a choice! ????

    No fight just a little perspective. Apple is one of the biggest companies in the world, not the mid-90's tech underdog. We don't have to defend them, they made their way back to the top.

    They own: Omega, Longines, Tissot,  Breguet, Rado,  Hamilton and several others.
