South Korea says Apple owes $46 million in unpaid taxes

Apple made wireless carriers pay for iPhone advertising costs, and a representative of the South Korean government says a tax bill is due.

Accounting experts for Korea's antitrust group -- the Korea Fair Trade Commission -- made the claim. Apple Korea is said to have made local carriers foot the bill of up to 30 billion won ($25.3 million), and Apple needs to shoulder 43.2 billion won ($36.4 million) in taxes because of the deed, with a penalty hiking that to up to 55 billion won ($46 million).

However, the Korea Times reported on Tuesday that Representative Jang Hye-young of the Justice Party believes that this is just the start of the costs that Apple must pay.

"Apple Korea has been investigated by the Korea Fair Trade Commission for unfair practices against local mobile carriers, and the National Tax Service needs to collect the corporate tax Apple Korea did not pay through inspections, amid these circumstances in which the company has made gains," the representative said. "Taxes should be imposed on the company for gains made from passing promotional expenses onto partner firms via having abused its dominant status in business relations."

In July 2019, Apple Korea proposed consent decree to the Fair Trade Commission. Apple agreed to change how it operates in the country, but did not plead guilty to the accusations.

"We don't believe we have done anything wrong but are happy to put this process behind us so we can focus on doing even more for our customers and communities," an Apple Korea spokesperson said at the time.

A source that spoke to the Korea Times isn't sure that anything more needs to be done as it pertains to the taxes demanded here.

"Apple already dealt with the issue. It drew up a plan and is following through with it," an unnamed industry source said to the Korea Times

The anti-trust investigation that this particular fine demand involves began in 2016 with raids on local Apple offices. The official filing said that Apple repeatedly forced local telecoms firms to pay the costs of warranty services and television advertising.

Exactly. Corporate shakedown. South Korea joined at the hip to Samsung.

Yeah, the Samsung Trade Commission. A lot of regulations coming out of South Korea lately that seemed designed primarily to kneecap Apple and Google and promote Samsung. Perhaps it's time to send them a bill for the protection by US military forces.

    Completely inaccurate headline.

The South Korean government said no such thing. A member of a minority party made a complaint based on their Trade Commission report. It is unlikely the ruling party will go along with it. There has been no ruling  from the gov't that Apple now has to pay.

Samsung has nothing to do with it. The dumb speculation that Samsung is behind this makes for great conspiracy theory discussion. The reality is much less entertaining.

This is political and about getting elected and raising your profile and Apple has about the biggest target on their back of anyone.

And you know what? If Apple violated South Korean tax laws then they should pay just as Samsung has had to pay up hundreds of millions to their gov't over the last few years.

That is just a dumb comment based on excessive Apple fanboism and nationalistic BS.

BTW, South Korea pay the US billions for military presence of the USA. There is legit discussion over whether it should be more, but the deal was renegotiated about two years to significantly increase what they pay.

Have some facts and knowledge before you spout off.

facts? on a forum? good luck mate. and you are correct, they pay a tidy some and even paid to move a whole military base to which a general said the kindness would not be forgotten ... only to have 45 send a larger bill.

It seems like the nationalistic BS is coming from South Korea. But, if they are going to play the what's good for Samsung game, there's no reason the rest of the world has to passively play along.
