    Possibly, but what if my brother had drafted a legal document saying life decisions are to be made by his girlfriend. That would hold just as much validity. Likewise if he drafted say an order not to be recessitated, it would not matter what the relationship. Finally suppose he drafted a document that left the responsibility to me instead of a wife or girlfriend. That would work as well.



    But the real issue is that you could of course simply grant these rights to domestic partners and again marriage would not be the issue. Likewise I've advocated, for homosexuals and heterosexuals, civil unions which would solve the problem of defining such legal relationships without resorting to marriage for homosexual or cohabitating heterosexual couples.
