You use common sense to understand they only have 30 seconds to show a demonstration of the phones functions and does not necessarily represent real world speeds.

The same way you use common sense to understand you won't have bikini clad girls all around you simply because you drink a certain brand of beer.

Google the Ad. Watch it. Study it. Watch it AGAIN. Study it. Time it. Time it again. DO it. Do the exact same things the iPhone does. If it doesn't do it at the same speed... Guess what? ITS FALSE ADVERTISING... LIES!

If I say that you can lose 10 pounds real fast like in 1 hour... And you don't... Guess what? I LIED!

Same goes for the Ads on the iPhone.... "REAL FAST!" Not the case

I have had lots of cellphones and they ALL have shown wear and tear damage, mostly due to the fact they are not in case, the iPhone is no different.

I have had the coating of a Samsung wear off on all the edges.

I have had a Motorola phone lose its black coating and get scratched.

My Sony Erricson looked terrible after a few months.

If it looks battered that is because it IS battered and not looked after.

If it is in his pocket with coins and keys then what the hell does he expect?

I generally try to put it in the opposite pocket as my keys, but yes, coins are always about. Don't most people walk around with keys, a phone and a wallet? Why would two of those things end up in the same pocket except by accident? Isn't that uncomfortable?

I wonder if the fact that you have to be a bit of an idiot to be "fooled" by those commercials or a bit of a dishonest jerk to try to fish for money you don't deserve has anything to do with it?

I mean if you have to be dumb or underhanded (or both) to be the kind of person who would file a lawsuit, then that kind of explains all these dumb underhanded lawsuits a bit doesn't it?

But am I going to sue? No.

You see there is this thing called "life," where not everything is fair and there is not always someone at fault just because you didn't get what you want.

Seriously though, the irony of suing a company for failing in it's responsibilities because you don't yourself want to take any responsibility for anything is priceless. Suck it up Murica!

I've got a lot of crappy American cars you can buy sir. They have problems - but that's life - suck it up Waldo! Gimmie your money sucker - gimmie gimmie gimmie.

You prefer hairline cracks? You're a corporate apologist hooker. And how! What's it like working for a company for free? Does it taste like man-meat?

Parky pretty much nailed it. Every phone (or portable device for that matter) shows wear-and-tear after a few months of use. Never have I seen a device remain pristine for the life of it's use. I have a white iPhone 3G that has about five (give or take) hair-line or smaller cracks in it. You can't even see them unless you are looking for them. I've seen lots of complaints about these cracks, but besides being able to see them, what have they caused? Anything? My iPhone works like new and surely isn't about to fall apart because of these "cracks". Is your iPhone about to fall apart?

I hate to make fun of people, but I have to agree. If you are that stupid to be "fooled" by Apple's commercials, you must live a rough life. I suppose we need to tell these people that they can't buy a house for $300, they can't lose 50 pounds by taking a pill, and they won't pick up chicks at the bar simply because they drink Miller Light. I think your second statement is probably more accurate, though. People are lazy and greedy, so they *think* they have found an "easy" way to make a quick buck.

I wish people could get in trouble for filing such frivolous lawsuits. How ridiculous.

It's called holding the company accountable. Just as if the government decided it was going to take an extra 5% from your pay check just because they feel like it. You would be screaming and yelling about that.

When you don't hold companies accountable for their actions, the consumers are the ones that get screwed. First it's a crack, then down the line it's a screen or a battery.

You don't feel a crack in your phone is important enough to make a big deal out of it. Congratulations, you're an individual. Thousands of other people would prefer that moisture doesn't leak into their phone through cracks.

When Apple sends out compensation checks, you can send yours back.

    THAT is life.

A consumer speaks with their wallet. Return the phone if it doesn't meet your standards. Many people wont buy North American cars because they don't feel they are as reliable as foriegn made cars. These are not structural cracks and the phone is holding together fine, what gives you the right to sue? Concrete cracks but it is still used. You don't know why Apple choose the plastic they did, and it honestly doesn't matter. If you don't like it, don't buy it. If you buy it you shouldn't expect the phone to be more than it is, and in buying it you are buying a phone known to sometimes develop cosmetic blemishes. That is not something you sue for. If Apple was not honoring warranties, you might have a reason to sue. You can't sue because a product doesn't meet your standards, especially when you can test it before hand and return it if you don't like it.

Don't be a wise guy. You finished editing long before I did my own edits.

You shouldn't have written those things in the first place.

Some other mods would have banned you from just your first post. I'm giving you another chance, so don't be snarky.

Congratulations, you just made 99.9% of all advertising on American TV illegal.

And yes, I'm specifically calling out American TV. These lawsuits pointing to rulings in the UK is irrelevant. Last time I checked, neither Florida or New York are part of the United Kingdom. Different countries have different standards for how much creative leeway you have in marketing products. The UK and the EU in general have stricter guidelines. Lawsuits in the US can't be based on those guidelines.

Do you think all the stuff you saw in the Super Bowl ads were real? Match.com "guaratees" me a match in 6 months, but you have to read the fine-print to know what that means. Just like you need to read the fine print of anybody's claims. Technology claims are pretty much always based on theoretical or ideal performance. USB = 480 Mbps, Firewire 400 = 400 Mbps, Gigabit Ethernet = 1000 Mbps, my DSL is 3 Mbps. Not a single one of those claims hold up under ANY real-world conditions. And yet Apple is being sued because in some areas you aren't getting the maximum performance. They can't hardly be expected to represent the real-world performance you'll get in your own living room.

If you're going to post, and then revise the way you just did, it's not a good idea.

When you direct a word such as that towards another member, along with even worse words, then it is simply not acceptable. It's not just one word, though it can be, depending on the word, it's also the totality of the post, and how it's directed.

You can say that someone's idea is fucked up, but not that the person expressing it is. The same with other terms.

But some are just not acceptable no matter what. You have to use good judgement.

We can get plenty hot here, and that's fine.
