After hearing news of two American customers filing a lawsuit against the US tech giant Apple for illegally collecting their location data last week, customers in Korea have started to wonder if they could sue the company for invasion of privacy as well.
[Interview : Chun Byung-hoon, iPhone user ] "I feel like my private information is being used somewhere but I have never thought of suing the company. If others do, then I might think of joining them."
Actually, a group of 29 customers in Korea have filed a class action lawsuit against Apple, the first such case in the country.
In a statement submitted to the Seoul Central District Court Thursday, the plaintiffs said that their location information was garnered through iPhones without their consent, and because the information can be shared with anybody using an iPhone tracker program, it could be an invasion of privacy.
They are demanding 800-thousand won, or roughly 740 US dollars each in compensation.
However, legal experts in Korea warn that the plaintiffs might not exactly be in a favorable position due to the judicial differences between the two countries.
Lawyers say that in Korea, there needs to be a clear proof of the cause-and-effect relationship in order for them to win the case. They also note that because it might be a little hard to find evidence, one should be careful when filing such case in Korea.

Supreme Court: AT&T Can Force Arbitration
The Supreme Court on Wednesday ruled that AT&T — and indeed, any company — can block class-action suits arising from disputes with customers and instead force those customers into binding arbitration. The ruling reverses previous lower-court decisions that classified stipulations in AT&T's service contract which barred class arbitration as 'unconscionable.' ... In cases where an unfair practice affects large numbers of customers, AT&T or other companies could quietly settle a few individual claims instead of being faced with larger class-action settlements which might include punitive awards designed to discourage future bad practices.
So it's clear who's side the US Supreme Court is on.
I.o.w. the US justice system is NOT 'blind' or impartial, but instead it is partial and biased: people's rights are castrated in favor of big business' "rights".
Exactly like in any other dictatorship. So the US is now defacto just another banana republic.
