That's very understandable. Many also thought the iPhone would double its max capacity of the 5. I wonder if they'll keep the classic, and if so, if they'll upgrade that 160GB HDD.

The only question is when thay say activated do they mean activating iOS7, and therefore any device that upgrades to iOS 7, or do they mean activated as in an initial purchase? My guess (or at least my hope) is that any device with iOS 7 will be able to download these for free.

Check the keynote at 19'07'' Tim says any new iPhone, iPad or iPod touch 5th gen. Sounds like 1st time activation to me. Anyhoo, not really breaking the bank here, buying 5 apps.
For sure - this is really disappointing. With all that CPU and GPU power there will be more and more apps working with lots of data (as if movies/music/photos don't already consume a lot). I don't want to have to move stuff on and off my phone so I have plenty of room to shoot video or download the latest multi-gigabyte app.

I quoted the footnote. The language is not explicit, but it is indicative, it talks about "qualifying" iOS7 devices, "activated after September 1". That implies that there are iOS7 devices that don't qualify, and that if it was activated before September 1st then it is excluded.
So no, I think you're wrong, and that some or all of the iPad 2, iPad mini, iPhone 4 and the 5th gen iPod Touch will be excluded from the offer, unless Apple change their terms.
Technically they could limit it to HW serial #'s, and not limit it to the iOS7 software. Oh well, we'll know next Wednesday. Will we be able to download it from http://www.apple.com/au/ios/ to be 'the first in the world'?
