    Well, we've gone over this before, but once again Apple is not a monopoly. MS had a monopoly position in personal computer operating systems market and used that position illegally. Apple does not have a monopoly position. And please don't try to argue that Macintosh computers is a market onto itself. That's as asinine as saying the Pepsi has a monopoly on Pepsi. (And I bet Pepsi would have something to say about it if I started buying Pepsi and bottling and selling it in bottles labeled PsyCola and marketing it as Pepsi but cheaper.)

    You're missing the point - you can do that for your own use, but when you start selling them and making profits off them without permission from Apple, you've gone too far.



    Here's something you might understand - try buying pictures of Mickey Mouse, and start manufacturing a boatload of Mickey Mouse merchandise to sell at a profit, without permission from Disney.

    In my opinion, the only thing I see boneheaded here is Psystar's counter claim and the level of rhetoric in the above post.



    Also, it seems clear to me now that Psystar is just some low-level operation. Nothing they've done leads me to believe there is some massive conspiracy of clone-makers backing them. Especially with their childish response on their blog post.

    I suppose the "agreement" reached is that Steve Jobs will not be deposed.



    Law suits are legalized war. Many people don't know that the plaintiff opens themselves up to a world of hurt by filing suit. A defendant can go after the plaintiff so vigorously that they wish they never filed suit and maybe even drop their case (not likely with Apple). Virtually any request by the defendant may be allowed, as along as the information that might be obtained can be argued to be even remotely relevant to the defense. The plaintiff already feels so aggrieved as to file suit, and now the defendant forces them to walk on hot coals. It doesn't seem fair.



    In Apple vs. Psystar, the reason to mount a vigorous defense is that it buys time and more opportunity for the plaintiff to make a blunder. Furthermore, some ancillary incident may be discovered, like destruction of supposed "evidence", that brings more pain onto Apple from the court than the relief Apple seeks through the law suit. Psystar might get the case dismissed because the "evidence" Psystar needs to defend itself might have been destroyed by Apple. This would leave Psystar in a very pretty position, both legally and business-wise.
