You get that in France huh? I guess I had only read of that as a real problem in British Common Law coutries like US, UK, Down Under ect. I didn't think people in France tossed that around like they do here?</strong><hr></blockquote>

Due to our judges, we have this in France too. Many insurance companies have discontinued their involvement in the medical aera. Half of the hospitals (private or public) will not have a policie the 31 december 2002. Many surgeons have lost their insurance policy. If nothing is done, a medical disaster will arrive next year. The governement will fix the problem (he is obliged) but at what cost for us.

Normally in France there is no obligation of result concerning the medecine, but an obligation of good management. Judges try to turn this : for example they reverse the proof of information. Before 1997 the proof of the lack of information has to be bring by the patient, Our supreme court reverse this : the doctors must bring themselves the proof of the information of the patient. We have adapted to this new deal, and make sign the patients many documents. The problem is that judges apply the same legislation for medical accidents commited before 1997 (you can be sued for a 10 years time after the date of the accident or complication) : thus no doctors is able to give a proof that he made a good information of the patient (it was needed before 1997).

The previous governement create a new legislation : in case of a nosocomial infection, the hospital has to proove he is not guilty ( in practice it's nearly impossible in 99 % of the time) or he will have to pay. That's why insurances company (and even the US ones) does not want to sell policies to hospital anymore.

The Justice in France SUCK, especially concerning the civil responsability.

i guess i'm with belle...i love my job...different than belle is that i work with the public and i have probably many bosses, but the public i work with are kids (who are great)and sometimes pregnant woman (who are crazy, but that's fun too) and i totally work on my own and ignore anyone who may be my boss....sweet....mostly i am left on my own and the pay ain't bad....

the downside is that lots of the kids are very sick and have a hard time ahead and sometimes pass much too soon....but i try to be as joyfull and playfull and compassionate as i can with each and every one of them...even on the darkest days at work, i would rather be there than have someone else who is less "caring" at the patient's and parent's side....g

i did hate going to work when my kids where first born as i wanted to spend every minute possible with them....but they are teenagers now and have this habit of rolling their eyes everytime i try to spend "too much" time with them....at this point i think they can stand about 15 minute bursts with dad.....
