Why would that make the system better? Sure you might stop some frivolous lawsuits like this, but you'd basically put well funded defendants above the law.
About a year ago, I came across the following article. It's a thorough empirical analysis of "loser pays" that's understandable by lay people like me. It recommends litigation insurance and a cap on the amount of recoverable fees to deal with potential problems with loser pays.
Historically (1977 - 2010) the number of patents filed in the US, by US entities, is the largest in the world; therefore, just like Windows malware numbers vs. Mac OS, the number of idiots ready to claim infringement is proportionally higher, and therefore so is the number of lawyers!
