The trouble is that this is a false dichotomy. It's not the case of more of one equals less of the other.
Competition is competition. Copying is merely one of the ways of competing but it's far from the only way. Innovation is another. It's possible to do away with (most) blatant copying without stifling true competition. Also, what's legal and not legal in terms of copying, is already very well defined.
Probably the real trouble here is the clash of cultures. In the West, the art of copying has traditionally been considered a 'low' or underhanded way of competing for almost as long as there has been commerce. They are trying to impose that viewpoint on Samsung.
It's very 'line in the sand'-ish for the industry, which gives the Judge even more reason to agree with Apple. If he/she doesn't, it opens the doors for even more blatant copying.

And just because certain societies in the East might think that it's perfectly ok to steal other people's patented and copyrighted ideas, that doesn't mean that it's ok either.
When it comes to human rights, individual freedoms, rule of law and basically civilized behavior, the Western world trumps everybody else in all of those areas. Not that the West is perfect of course, but it's far better than anybody else.
I would also add that my 1080p Samsung screen occludes around 20 pixels on every edge with the bezel. Maybe it's just me but in my opinion that ceased to be acceptable when the CRT was abandoned.
It's still kind of a default setting for pretty much every TV I've come across. Did you look into your settings? My Samsung doesn't do that, I changed a setting somewhere in the menus.

The "home" screen looks exactly alike, the overall shape and design of the hardware look the same! Are you serious? Are they serious!? If that's not trying to fool people into thinking that the products are the same, then they are either dumb or blind!

I guess even they can't sue everybody infringing their patents, they need to pick their fights and they've decided to focus on Samsung and HTC, perhaps because Moto and S-E are busy dying without help or perhaps because they're not infringing quite as badly and Apple's lawyers felt their case was strongest with HTC & Samsung.
At least with the patents Apple isn't obligated to go after all infringers equally, if you've been following MS with their raid on Android they started with HTC and are now busy picking up small handset makers, I guess you have to be a patent lawyer to figure out the reason behind the tactics - either that or smoking whatever Ballmer is smoking.
It does make one ponder why a person naming themselves 'Androidinsider' would want to post on a well estalished Apple forum though?
