If the FBI wants the passcode to that one terrorists phone, they should stop bothering Apple and approach the banks that the terrorist dealt with. Get the BANKS to disable the 3 tries protection they have on PIN entry and then brute force the debit card(s). I'd bet a large amount of money that his iPhone passcode is the same as one (or all) of his debit card PINs.
