I thought most of these cases are determined by a material consumer harm, vague, but at least based on something other than hurt feelings maybe. There’s effectively no consumer harm here. Just like with the storage being in decimal versus binary or formatted, there really isn’t consumer harm. Heck, the iPhone X, XS, and 11 Pro actually have 5.85” displays, so whatever computation the plaintiffs did is probably off.
If some product or service isn’t what the company says it is, there probably is a case, like some of the examples I listed, like energy prices. Most people won’t read the small print, and they’ll sign up for a plan never realizing that the costs of their energy is actually 10% to 25% more than what they signed up for.
Mind you the question is not whether anyone cares, the question is whether Apple is deceiving the public. Personally I don’t think they are, but the issue in the headline, that “nobody cares” is really irrelevant..
If you measure from rounded corner, you leave out a huge amount at the sides and bottom! The thing about the cut-out is this: you can immediately identify when someone has an iPhone. Thus, you can tell if you can share a photo with your pal via air drop! It's a minus that's a plus ;-)

TBH, they should get sued, because any engineer that states that something lasts as long as it is rated for is not doing their homework in "padding the specs" class.

Best example: iPhone 6 and Watch were water resistant way before they rated them as such. Meanwhile IP67 knockoffs from Samsung were failing water tests.

I don't see a downside to Loser pays, it would prevent who knows how many useless frivolous lawsuits in comparison to perhaps the few situations where someone won't sue because they think they'll lose, and if they think that up front, chances are they will.. And I suspect that many of these useless suits are lawyer generated and the plaintiffs are merely willing accomplices to start the suit or class action..

Many people (not all, or even most) suffer from a severe "entitlement" condition where they feel that the world is against them, or trying to take things from them. They can't comprehend that Apple's notch design actually gave them more! It's not good enough. They need more and more and more! That mentality is a vicious cycle, though. As soon as Apple addresses their concerns, they find something else to complain about and feel victimized by. They can't see past their own nose. It's amusing.

I think the judge used the reasoning ..... that not many consumers are harmed by whats the suit is about ....., to deny the suit "class action" status. The judge did not completely deny the suit because he might have thought the suit was frivolous. The judge did not deny the rights of the 2 plaintiffs to sue Apple for damages and maybe be awarded $10 a piece if they can prove any harm. But without class action status, the lawyers can not solicit for more plaintiffs to share in any win, to get an award that might be in the 10's of millions of dollars, based on how many consumes, that purchased the iPhone (in the suit), signed up for the class action suit. Whether those that signed up felt they were harmed or not.
