RIAA will not pick up its bat and ball and go home. ITMS sold 1,000,000 os so songs its first day. That is $990,000 on day 1. If they pick up their bat and ball and leave they will be faced with more pirating and get absolutely squat for it. They know very well that they can NEVER stop pirating. If they develop a tech to beat the pirates some pimply faced teenager will find another way and RIAA keeps loosing sales. The best thing RIAA can do is make it so incredibly painless and affordable to get exactly the songs you want that you will have no need to pirate. This is what ITMS does. Its cheap, its easy. You have to remember that piracy wasnt as big a deal when the price of a CD was around $8-9. When the price jumped to $15-16+ then the napsters and such became popular. Like I have stated before, buying a complete CD is generally a waste of money. Of the 10 or so songs on there there are usually 2-3 that people love and listen to reqularly. Another 2-3 that people can tolerate and the rest are songs that people dont like. There is rationalization available to pirate. Why should I spend $16 for 3 songs??? If RIAA makes that rationalization dissappear through ITMS or similar venues the number of people pirating will drop to those few who just want to do it cause they can. The majority of people in this country and the world arent total a$$holes looking for a way to rip off the next target. If RIAA makes it difficult to rationalize the theft people will simply spend their $0.99 per song and be happy.
According to the folks posting at MacSlash, the limit for shared library listeners is 5, well below any definition of broadcasting. The 3 magic number is the max number of authorized users to share the Music Store files.
