This is the Aussie way of showing " respect ". OK
It's a cultural thing..we love to knock " tall poppies "...
So pleeze don't take it personally..i just want to poke you in the ribs a bit....
Don't worry, I didn't, that's why I didn't freak out, for a change. Moreover, I am fairly self-confident (read: I'm a self-satisfied prick) as it comes to my intelligence, so you won't quickly corner me in that department.
On a general note, this thread is NOT going well for me.
Whoops, sorry for the potty mouth gang....got carried away. Had a little too much of that Old Janx Spirit this morning...couldn't find my towel. Promise to try and watch my language from now on.
[B]None of you came back with arguments whether the charges pressed against Tommy Franks are valid or not.
Hold on there Sapi..
First of all ...we're not all americans OK.
Second, as regards the validity of the laws relating to General Franks, if you care to note I am concerned about the "un-even playing field" particularly, when it comes to criminal charges of the genocide......war crimes type.....
I am balanced in my perceptions,
but am within my rights to doubt the so called impartiality of self appointed European Judges.
As to the legalities or otherwise of the charges, I am not an international lawyer. But for my ten cents worth, this is just so much political sideshow fluff..
As far as I am concerned, this is just another way for a pathetic Europe that has been sidelined with regards to Iraq, to throw it's weight around.
Don't get me wrong...
I am a vociferous critic of US policy when it is wrong...
I hope your the same with your precious Euro-centric hyperbole.
So instead of discussing the validation of the charges you prefer to discuss the political sideshow fluff of the Europeans.
Try this: Belgium is a democracy, whether it's ok to have Belgium judge american generals is another topic, but according to their system a judge can decide if he's guilty or not. Let's discuss if the charges are valid or not..
And sorry for calling you american. That's insulting, I know.. again sorry..
And sorry for calling you american. That's insulting, I know.. again sorry..
Hooray for trolls!
Now getting back to the gist of the matter I must take issue with some of Mr. Kopf's statements. Such as:
Quote:
Reading these, oftentime hateful, comments, I think it needs to be stressed that the Belgian government is not involved in this case (as far as I know, anyhow). It is not the government that has brought the charges, and it is not the government that will treat them.
The Belgian govt, and by govt I don't necessarily mean the present politicos who compose it, are still responsible for this in large part. The genocide law or whatever it is called is still of their own doing. They passed it. Even with the recent restrictions that they placed on its use they have still basically designated their national judicial system as an international clearinghouse for war crimes trials to which they are completely a third party.
They're essentially usurping national judicial systems, intentionally or not, especially before htis law was revised. I understand that they support a strong international system for such things but the proper place for that is the ICC not the Belgian courts. Nations get to choose what obligations they sign up to under international law and the US has chosen not to. Deal. We'll see which way the new Iraq wants to go on that but they are not a party either.
Quote:
There is hardly 'incredibly higher media coverage'. The issue has been mentioned as third or fourth item on the national radio news (and television news). Coverage is slim.
It has made the top set of stories at both the BBC online page for the World and Reuters and the AP. All are among the most prominent international news organizations in the world at least for English language coverage. To try to play it off as not getting much attention seems a bit contrary to the facts.
Quote:
Yes and no: after the charges against Sharon and the ensuing embarrassment, the law was changed so as to allow the courts to pass the case to the country of the charged if it can be assumed these courts will handle the case with enough neutrality.
And the person who makes this decision is a Belgian prosecutor correct? If so then basically your system still puts complete trust in a small set of individuals to make choices. I trust that like most individuals or bodies they will make reasonable decisions in most circumstances and questionable ones on occasion. I presume that the people who deal with such formal complaints as Mr. Fermom has brought are not elected. I should hate for politics to have to nag at the back of their minds.
Quote:
How exactly? I'm not sure, I'll repeat, that this is a relevant case and that Belgium has the jurisdiction, but give me one good reason why crimes that happen in this manner (during a war / dictatorship) should not be judged upon in any way possible?
Belgium has the jurisdiction simply because you decided to give yourselves the jurisdiction. I don't recall the US signing on to let your country's judicial system judge us. Nothing is a crime but the law makes it so. Perhaps we should pass a law here in the US that allows us to prosecute Belgians who smoke weed out? Or we could prosecute those who bang on the backside. Perhaps China can pass a law giving themselves universal jurisdiction over people who conduct hte same sort of religious activities which are verboten in China. Wouldn't that be lovely? Crimes should be judged by the countries in which they happen or by the countries in which the perpetrator or victim is. Belgium's law allows it to intervene in cases where none of those are the case.
Quote:
Suppose that mister Franks WAS responsible for things that demanded a high civilian death toll, yet served no military purpose. Or that a marketplace WAS shelled at random, serving, again, no military purpose. Should there not ensue some kind of judgement?
If those are issues then they should be brought through the US system or through the Iraqi system once it is reconstituted.
I think that you know you are barking up the wrong tree. There may have been individual actions which were crimes, probably were. As far as actually physically engaging in a war crime, I don't htink anyone believe that to be the case. As far as overseeing a large pattern of military tactics the results speak for themselves. There was no attempt at a genocide, except perhaps by a few Iraqis who did not succeed if they did try as much.
And sorry for calling you american. That's insulting, I know.. again sorry..
I am hearing from little fiefdoms of lazy Europeans who are too busy with their six-weeks of vacation and with their noses buried too far up their government's bum to make an impact in the world. Your country has a dead culture and your populations are dying---except for some immigration from Africa and elsewhere. In the grand scheme of things you don't make a pimple on the the U.S.'s ass. Little has-been countries that are economic and cultural failures don't hold much sway in the political and economic game.
But, by all means, go ahead with your little clueless judicial pity party, and see what it gets you. What does amaze me is that you are too senseless to treat the most potent economic and military force on the face of the earth with tact or respect.
But then maybe that's all your countries have left to do.
You present a compelling argument, ColanderOfDeath. I think I might have to conclude that Belgium does not have the jurisdiction to judge in these matters (although I have not really concluded otherwise before). I think I might be able to support a slimmed down version though (a little slimmer than it is now: either the victim(s) being Belgian, or the case moving to the country of the victims or the country of the perpetrators or an international court supported by either or both of those countries.
ena, I for one wouldn't mind if you'd refrain from posting in this thread, unless you decide to present something that is not pure hatespew and, you know, maybe, makes some sense. It seems clear that you disagree with some things, so, why not, instead of going around in your very insulting manner, lay out your case and prove, for once, that you are NOT an imbecile. I know I do show my naive confidence in humankind here, but I do believe that that dirty little mouth of yours can do something else than what I've seen it doing so far.

....there is no case---only an bunch of inbred cowards can look at the state of the world and pick Franks worthy of war crimes charges. I understand the slow kids in the class don't understand that, but I'm not going to set the rest of us back for the sake of a few slow learners. It's not worthy of intelligent discourse.
Your insignificant countries are only coming off as belligerents with an ax to grind against the U.S.---even if you have contrive nonsense----too senseless to stop kicking at a country that quite frankly doesn't need any more static from yip-yip dog counties that are smaller that some American cities.
We are going to do what we want, when we want, and how we want. The sooner your 1/72 scale country stops nagging us the better. You are only going to succeed in radicalizing yourselves while losing credibility.
I'm sure you'll start seeing things in perspective when you get to go to junior high. Also, you are committing the same fallacy as some of your more stupid compatriots so eagerly do, but let me state the obvious, as you don't seem to realise this: you are not your country. Even if your country gets to say more in this world, that does not preclude, in any way, that you are an insignificant stupid little git, or a smart person, or whatever. I hear ColanderOfDeath reaching for the 'vegemite sandwich' rap, but that is the way it is, ena. I have no doubt you will realise this sometime in the future.

"the way it is" is this:
We, as a country, we are 150% SICK of this whining. If you are counting on CNN and the Dixie Chicks for a barometer of how much longer you will be taken seriously as a country---think again.
Get a clue---to the average man on the street you guys look like morons. You are too stupid to shut up and at least try to salvage a badly damaged image! What kind of an idiot repeatedly pisses off the most powerful nation on the planet? And then to top it off, tries to shame a popular military leader? YOU HAVE NO SENSE.
Do you have any idea how sick we are of hearing this crap? You simply have lost the chance of being taken seriously.
But by all means listen to yourselves, you will find out exactly what you want to know.
Maybe you guys should stay out of those bars in Amsterdam.

Another quality post by the world's most powerful loser. You are just ONE person, ena, there's no need for the pluralis majestatis. It's amazing how you equate people with countries, you, America, trying to stare down Belgium and ... wherever sapi and Harald are from. You are rather mistaken in doing so, however, and again, you will one day understand this, yet till that day, you will mildly amuse me with your displays of below average intelligence. You ARE indeed what Americans and foreigners alike hate about America. You are, yes you are, you little fluffy poodle person.
None of you came back with arguments whether the charges pressed against Tommy Franks are valid or not.
What the hell are the charges? I'd love to address this but there is no substance?
Genocide?
War crimes?
And beside that, how do you argue against charges in an invalid and pointless court with no mandate?
Quote:
Instead you attack der Kopf, Belgium, and you show what Americans in general think of other nations, its laws and people.
I look upon small and unimportant-in-the-world-scheme nations who act as if and legislate as if they have universal jurisdiction with disdain and will discuss such actions without a modicum of respect, I admit that right away. I won't discuss a homeless man on Guadalupe passing out jaywalking tickets with any respect or humility, either.
And as far as picking on poor der Kopf, perhaps you should teach him how to present something in a neutral manner. Read: "I want this to be neutral, Franks is a bastard." v. "I want this to be neutral, I have no comment on Franks." (Guess which one is a paraphrase of his first post!)
All of his "be nice, no 'hatespew'" is pure hypocritical garbage, he can't keep his own hatespew out of the first sentence of the first freaking post of the entire goddam thread.

An unusually moderate post. Bravo, groverat. One thing though: I did not write "I want this to be neutral, Franks is a bastard.", and I didn't mean to convey that message either. Rather, you should, and are allowed to read: "I want this to be neutral, but the army is stupid. A lousy bunch of phallic nibblers that deserve noones respect whatsoever. Good men have entered false causes though, so Franks deserves the advantage of the doubt."

The same point as made by Kopf.
YOU deserve no respect because you are making a twat of yourself.
Your country meanwhile will have no peace while it does what it wants when it wants.
