A muslim works for a record label. There is one refrigerator in the kitchen and the management refuses to put another one in when the worker (a dj, say) complains when she sees a blt open faced on top of her light salad (it seems that the owner of the blt sandwich didn't quite seal it shut when he made it that morning). She isn't being descriminated against by the label. She isn't forced to use the refrigerator or even the kitchen. Now if the label stated that she must use the kitchen to prepare all food because of a rodent problem, then she would have grounds for a suit.
In this case no one is forcing this woman to bring her lunch. No one is forcing her to bring pork. She may even be require to wear a little blue wal-mart vest on her weekend job or even better to not wear a miniskirt there. These are acceptable requirements made by an employer.
Lets say you were a woman that worked for an amish family selling bread at a local market and they wanted you to don the standard garb that hides all skin but the face and hands. That isn't descrimination against you as long as you don't have a religious practice that calls for wearing a particular clothing item.
I have to agree with SDW here. This is AMERICA. I have a right to eat what I want for lunch and not have my employer discriminate against me because I don't practice THEIR religion.
You have every right not to work for a company with this policy. Don't like the terms - don't agree to them! If this were a govement department it would be a different issue!
Many food production facilities have no eating rules. Many companies have no smoking rules, most have no alchol rules & no other drug rules.
If you worked for a company that made vegetarian food you might have a 'no meat at all' on the premises rule.
Don't like it : go off site during the lunch break, then smoke, eat pork, do drugs, wear anything you like. While you are at work - follow the rules.

I can understand no consumption of carcinogens, alcohol or any otherwise detrimental products to other employees. Second-hand smoke direct affects others. Alcohol impairs my ability to do my job safely. But my ham sandwich does not directly affect anybody else. I find the body odor of the guy next to me personally offensive, but I would never demand he be fired. I find the slurping sound the Asian guy across from me makes when he slurps down his noodles disgusting, but I would never demand he be fired either.
I understand the logic you guy's are using...but I do not agree at all. It's personal discrimination based on criteria that holds no weight because it has zero direct effect on anybody else.
Also, why would an employer want to limit its pool of talent based on their personal dietary habits. "I find the work of this Indian graphic designer exceptional, but I can't hire him because he uses Curry in his food and I hate the smell of Curry..." That would be insane!
not eating pork is insane, i just had a brown sugar ham sandwhich that was awesome. no other way to describe it. I would sue the pork sandwhich out of these fanatics imposing their religious extremism at the work place. you want to come to America fine but dont expect us all to change for your from 1st century beliefs. we are in space now year 2004 and eating pork is fine in moderation as anything else. zealots! fanatics! exremist! they all suck

If US anti-discrimination laws are similar to Australia's and I'm sure the fundamentals are pretty much the same, this is the logic the law uses as well. I remember the first time somebody explained it to me. Took a while to get my head around it.

As I understand it, discrimination law says almost the exact opposite of this. Because it has zero direct effect on anybody else it's not discrimination. The issue as far as the law goes is whether by not eating pork she's being subject to discrimination based on HER religious beliefs, disability, race, gender (think that's all ours covers). Not being allowed to eat pork because her boss is Muslim is irrelevant.

As I understand it, discrimination law says almost the exact opposite of this. Because it has zero direct effect on anybody else it's not discrimination.
