Even the latest iOS version found inspiration for several features from Android.

Considering Clean Room is rarely (if ever) used in patent defense cases, not to mention the fact that 1) Andy Rubin is not on trial (or employed by HTC) 2) No one is charging Andy Rubin with anything.
