Hardware manufacturers probably would love to dump Android now. Except Motorola, every Android hardware manufacturer pays a royalty to Microsoft already which roughly translates to what they'd pay Microsoft for a OS license. Further, Microsoft indemnifies hardware partners from lawsuits over parents, something Google does not do. Manufacturers, however, aren't going to abandon Android unless they can get customers to use something else.
That's undoubtedly true. But if you were a phone OEM, you'd definitely be giving Windows Mobile a lot more attention. Perhaps instead of selling only Android phones, you might have a couple of Windows phones. Or perhaps instead of 2 Windows phones, you might have 5.
However it plays out, it will work to Microsoft's advantage.
Sanjay Jha...dude seriously earned his millions. My god he sold the proverbial sows ear as a $12.5B silk purse to Google by pointing a loaded patent gun at Samsung.
I understand that Google is trying to be "nice" here, but if they really want Android to succeed then they need to follow Apple's business plan and close off Android to Motorola's phones. Doing so will help eliminate the OS fragmentation that exists today and make Android more competitive against iOS.

Personally, I appreciate Google's effort. I am sure this will make a lot of Xbox users quite pleased. Banning a wildly popular consumer product is not a good strategy for the "Do no Evil" company.

There's a really simple time-honored and proven solution: Negotiate a cross-licensing agreement as is frequently done when two companies have a boatload of IP that both need in order to offer their products and services.
If MS would rather not do that, then what other avenue would you suggest to Motorola?

ITC administrative law judges hold hearings to investigate claims of IP infringements for products imported into the US, under authority of the Tariff Act. Their judges' findings and recommendations are then heard by the full ITC commission board who can do a few things with it. They can accept the courts recommendations, they can accept with minor changes, or they can send it back to the court to reconsider.
In this case if Judge Shaw's ruling is accepted by the ITC commission it becomes final and then sent to Pres. Obama. He has 60 days to review it, tossing it out if he chooses or letting it ride. After that 60-day review period the final determination can only be appealed to the Federal Court of Appeals.
