    Absolute rubbish. Have you read the pre-order figures for the new Samsung Galaxy SIII, and it isn't even sexy looking!? Amazed me how Apple fans are in total denial about Android.

    However it plays out, it will work to Microsoft's advantage.

    I understand that Google is trying to be "nice" here, but if they really want Android to succeed then they need to follow Apple's business plan and close off Android to Motorola's phones.  Doing so will help eliminate the OS fragmentation that exists today and make Android more competitive against iOS.

    In an early win for Google's newly purchased patent portfolio, the ITC court published it's recommendation yesterday that Microsoft's Xbox be barred from importation, having been deemed infringing on a couple of Moto patents. Assuming the board confirms the judge's recommendation it goes to a Presidential Review, same as Apple's request to bar the Samsung Galaxy Tab 10.1. Unfortunately for MS, Moto's isn't asserting easy-to-fix design patents as Apple is (they're not FRAND either), but personally I'd expect the President to come to their rescue if/when it gets that far.

    Why in the world would the President 'come to the rescue' if ITC turns out to be correct and xBox is banned? It's hardly strategic for U.S. interests.

    Furthermore, it's a little early to be counting chickens on this one. ITC has a record of being overturned very, very often. Even if the board confirms the judge's recommendations, Microsoft can head to court to get the ban stayed and the issue heard by a real court.

    Personally, I appreciate Google's effort.  I am sure this will make a lot of Xbox users quite pleased.  Banning a wildly popular consumer product is not a good strategy for the "Do no Evil" company.

    There's a really simple time-honored and proven solution: Negotiate a cross-licensing agreement as is frequently done when two companies have a boatload of IP that both need in order to offer their products and services.


     


    If MS would rather not do that, then what other avenue would you suggest to Motorola?

    For those who aren't sure what impact an ITC ruling has, here's the process.


     


    ITC administrative law judges hold hearings to investigate claims of IP infringements for products imported into the US, under authority of the Tariff Act. Their judges' findings and recommendations are then heard by the full ITC commission board who can do a few things with it. They can accept the courts recommendations, they can accept with minor changes, or they can send it back to the court to reconsider.


     


    In this case if Judge Shaw's ruling is accepted by the ITC commission it becomes final and then sent to Pres. Obama. He has 60 days to review it, tossing it out if he chooses or letting it ride. After that 60-day review period the final determination can only be appealed to the Federal Court of Appeals.
