    They are not facing legal issues because they did contact Apple, and Apple brushed them off. They made an effort to return it and got no call back according to the story that's being told.



    I don't understand the high emotions about the case. Most folks immediately cover their phone in a protective case or sleeve anyway. It's just a phone. I don't think it's 'hideous'. It's just glass and metal. I actually like the buttons.



    The bezel edge appears to be smaller on this model than the 3GS. The distance from the extreme edge of my 3G and GS to the actual display area is about 4mm. This one appears to be much smaller (about the width of the screw down by the speaker. If thats true, the actual display area may not have changed all that much and the smaller form factor may just be due to removed bezel (wasted) space.

    They are not facing legal issues because the 4th gen iPhone hasn't been released yet. If Apple decides to do anything, they will do so after they release the phone. Calling up Apple and saying "yo, I got this iPhone that doesn't look like an iPhone, but I think its yours" isn't a reasonable effort to return it in my opinion. I can only imagine the the weird phone calls they receive.

    What would you suggest they do? Just send it to them certified mail? They contacted Apple, and Apple wasn't interested. If Apple was truly concerned, they would have prepped their phone folks about a lost prototype. It's really not that hard to communicate something of that sort.



    It also not like their spilling some huge industrial secret here. It has all the same basic components as any other modern phone. It's not that 'sensitive'. The OS is the most interesting part, and the rest is just interesting.

    He didn't know it was a 4th gen iPhone when he found it. If he had no intentions of keeping it, he probably would have given it to the bartender to keep until the guy came back looking for it (which he did). Gruber also pointed out that you are legally required to turn it over to the police before you can claim it as your own.



    I'm not making any massive attacks against Gizmodo or the guy who found the iPhone. Just pointing out the obvious. It does appear that Apple has some legal grounds to go after Gizmodo (if they so choose), and if they did, it would be after the iPhone launch (for obvious reasons). That is all.

    What do you mean by clear glass? Do you mean so you can see the insides of the phone?



    Maybe the aluminum band will be made in different colors, like the iPods.

    I was quoting Prof. Peabody and he was referring to being able to see the inner workings of the device, yes. I don't think the iPhone will get the nano treatment yet, but who knows.

    Many before me have said this but, feature set does not mean superiority:



    I have a sprint fusic before my iphone and it had a radio transmitter on it, however I think I only used it one or twice because in about 10 min it would run the battery dead.



    So some people with say (if Apple ever added the feature) "OMG they are so far behind"

    Even if Apples version lasted hours.



    Also, the screen does not need to be bigger, higher resolution I am all for and maybe extend it farther to the edges of the phone, but not a bigger form. It still needs to fix in ones pants pocket.



    Something that would be cool to see and I think there was some stories on it a few months back, but those little transmitters so you could tie your debit card into the phone and swipe it on those scanners. Maybe even car insurance and drivers License.



    One more thought,



    I would like to be able to add folders on the phone for email, and folders for pictures taken on the phone, I pay bills a lot on my phone and use screen shot to save the Conformation numbers.

    True enough. I was mainly trying to figure out what Steve Jobs might have meant by the "you ain't seen nothing yet" comment, when he was asked about whether the Gizmodo iPhone theft thing had taken all the surprise out of the next iPhone announcement.



    I can't see as to why they'd be making different sizes at this point, and the different capacities all use identical exteriors, so I was reaching for materials choices I guess.



    Like as not it was just ad-speak/puffery or refers to some minor software improvement.

    In addition to what we still don't know about the next iPhone (which is a lot), perhaps we'll get a 10.7 preview? One can dream.

    As the Owner of a 3G, I will be buying this. My iPhone lives in a case anyway. This thing could be bright pink with flower power daisies on the back and I wouldn't really care.



    I just want more horse power, sane multitasking and better battery life.



    Tho' I am not sure the last two can co-exist.

    Only Steve Jobs and Jonathan Ive know how the final product will look like.



    I'd be very surprised if Steve would give the actual iPhone 4G to a 27 year old engineer who got drunk sometime in March and forgot about his phone



    What the engineer probably got was the technology of an iPhone 4G, not the actual hardware! It looks like they stripped the phone off his (ergonomic) shell. That would explain the nakedness of the prototype.
