Siri is the first thing that gets switched off on my iDevice. I don't want the world (or anyone within earshot) to know my business.
If Apple was really illegally spying on you, turning of Siri in Settings wouldn't affect that as you're devices still have microphones and cameras on them, not to mention all the stuff you type into them that could be used to spy on you.
I’m not sure this is legitimate. I look at the box the unit is removed from and I don’t see the typical care and design Apple usually gives to its packaging. Look at those cheesy white cardboard separators and see how the Apple TV itself doesn’t fit in the box properly. Then I consider the purpose of this video. It seems to be more a chest thumping, “Look at me. I got one of these and you don’t!” than an informative video. Then the presenter says he’s going to hook it up and start testing. Will Apple’s servers even recognize it at this juncture since it’s not scheduled for release until ‘late October’?

I think his concern is about the quality of the box itself, which I also thought looked less Apple-y than I would have expected due to that thick corrugated paper divider.
That might be true but on the Underground doing a 'Hey Siri' is an invitation for those around you to listen in on your business.
Sorry but IMHO this is one bit of technology I can do without. I do have some track record in this area because I did an MSc in Voice Recognition in the early 1990's. I came to the conclusion then that yes it has an application but in its own time and place. On my iPhone/iPad or ATV is not one of those. I even stop my car to make calls even though it has hands free kit.
Mind you, I',m a certified Grumpy Old Man so my opinion does not count at all.

What does "the Underground" have to do with using voice control in the car, at home, or otherwise alone? I, for one, look forward to more efficient and effective voice control. I want the time savings that will come from it.
Not sure I like the look of those buttons. I think the current Apple TV has a great aesthetic and tactile feel to its concave and convex buttons, these ones look flatter, chunkier, more pronounced, and more plasticky.

in the case of Hey Siri, its an optional feature to use when its convenient for you -- theres no reason to feel like you have to use it when you're around other people.
I'm not a fan of the industrial design. The former model's proportions seemed pleasing-this, not so much. If they needed the height for wifi, perhaps they could have done a more narrow base. Perhaps they could have used aluminum? Or even white plastic, to match the AirPort Extreme/Time capsule product family.
This is more likely to match consumers' preexisting A/V components for sure, but Apple had an opportunity to completely redesign it. The industrial design still speaks "hobby".
suggestion: use the damn thing before you decide it sucks.

Apple just changes its name in countries where Siri doesn't work.

I'm not quite clear what Apple will require the storage to be used for...Apps and Games seem like
the obvious reasons. But will you be asked about storing music on the device? Photos? It doesn't seem practical to store
movies or tv shows on it, except perhaps the one(s) you intend to watch immediately, if streaming
isn't going smoothly temporarily (for ISP reasons).
