Given that they could have released such an emulator for their very own current devices, and have not done so, even going so far as to close down the online stores for the older devices, suggests that your claim of "likely" is somewhat of an overstatement.

Apple responds to DOJ antitrust lawsuit by refuting every claim
Once again, what Apple is doing now isn't as relevant as what Apple did then. Without commenting on the merits of the case the DOJ thinks it has (about which I know no more than most here, and less than many), if Apple committed violations of law within whatever, if any, statute of limitations might apply, they are still liable for those violations, regardless of whether or not they've stopped those violations since then.Can you imagine a thief using "well, I don't do that anymore, so this case is invalid" as a defense in court? It wouldn't be a valid defense for the thief, and it isn't for Apple. -

Without speaking on the merits of DOJ's case, about which I know little to nothing, if Apple violated the law then, they're still liable for those violations, irrespective of what they've done to fix them since. You don't get a free pass on past crimes just because you've stopped doing those crimes. Again, I have no knowledge or opinion on the DOJ's case, it's just that the notion that Apple made the case moot because it has fixed their issues seems a little silly to me.
