It wouldn't be a valid defense for the thief, and it isn't for Apple.Also, the DOJ is using its (admittedly odd) market share/revenue share based on Apple today, not Apple 5 years ago. So if Apple changed something 4 years ago what was their share of the market at the time of the change. To me it doesn’t make sense to say, “Back in 2019 Apple did this but in 2024 we’ve decided they now have enough share to sue over it.”
