It's clear that there are 2 examples of affirmative action in the Constitution- the electoral college and the fact that each state gets 2 senators, regardless of population.

    - an action or policy favoring those who tend to suffer from discrimination, especially in relation to employment or education; positive discrimination.

    Personally, I see why one would want affirmative action in a society that is still highly unbalanced, but if one doesn't see how it's ultimately a short-sided solution that will eventually reveal it's own shortcomings in trying to establish a more fair solution then one simply isn't looking at its pros and cons.

    Somewhat diminished by the fact that unlike others (though not all) in Silicon Valley Apple employees do not get the holiday as a paid day off.

    That's simply not a reasonable thing to say. It definitely has a long history of giving a more equal footing to the underprivileged. The problem is that it's not a sustainable idea for a truly equal society.

    One could think of it as training wheels for fairness in a diverse society, but eventually the training wheels need to come off even at the risk of failing down as a result.

    It most certainly is reasonable to say. AA has been divisive ever since its inception. Propping up one group to the detriment of another is blatant racism. Because of AA we now have artificial quotas that must be met in hiring and collegiate application policies which places importance on the skin color rather than on the individual.

    They do and I think that's quite awful.   The current movie Selma couldn't use any of King's actual speeches because the family apparently sold the rights to Steven Spielberg for another film.   

     

    I would have thought that anything spoken in a public forum by a public person in which press was present would have entered the public domain.  

     

    But regardless of what Apple does on their home page, I think this day does little to remember King properly.   What I did notice is that the shopping malls are swamped.   Why people feel they needed to shop today instead of Saturday or Sunday, I don't know, but it's become just another day to buy a TV or mattress or game player.   I don't think King would have been pleased.

    So do the trustees of the Albert Einstein estate. I once got sued by them for using a photo that I paid to have shot with a male model next to a chalk board with a sweater and grey hair similar to Einstein's. We settled the lawsuit but it cost us a few thousand dollars. I didn't even know about the celebrity likeness law in California at the time.

     

    I wonder how much Google is paying for their "likeness" representation of MLK on their home page. It is hard to believe that you would have to pay for representing someone who has a national holiday in their honor.

    When a patient goes into the hospital they hook them up to a IV. No one expects them to live the rest of their life on an IV. It is a temporary measure until their condition stabilizes and they recover.

     

    Everyone benefits from minorities gaining an education.

    It goes both ways. If one group is being and has been discriminated against for so long the discrimination has become both institutionalized and culturally embedded affirmative action may be required. Exactly because discrimination is so culturally embedded affirmative action can appear unfair. To open eyes and change minds can take a long time. Case in point -  Ridley Scott's 'Exodus'. (What were they thinking?)
