You're right, but you can't blame the poor jury (who are non technical) to get this right. Not to worry though, through appeals & prior art invalidity Apple won't get a dime and will eventually (5 years too late) realise the best tactic is to be aggressive in the market place, not the court room. Bring on the Apple phablet style phones to compete with Samsung, which should have been here two years ago. Silly strategy Apple, bad for your shareholders.

Didn't say that at all... Apple is doing well in the market place... they could be doing even better if they spend their millions on further marketing and research, releasing competing products (phablet, iwatch) than than give MoFo millions $$ to play out the legal theatrics..

That's a great point. Now those lawyers can get back to doing the R&D and marketing for apple that they're paid to do. As big of a company as Apple is, you think they'd have different skilled workers to handle specific tasks instead of using the same guys for everything. Crazy apple...

But it's up to Congress and SCOTUS to determine how that is enacted. So you do not have to "change the constitution" to effect change.
